1. Acceptance of Terms

These Terms & Conditions ("Terms") form a legally binding agreement between you ("User," "Landlord," "Tenant," "Buyer," or "Visitor") and HOMES by ASB ("Platform," "we," "our"). By browsing homesbyasb.com, submitting a property listing, creating an account, or scheduling a site walkthrough in Ranchi, you agree to comply with and be bound by these Terms.

If you disagree with any part of these terms, you must refrain from using the Platform. We reserve the right to revise these Terms periodically to reflect operational improvements or statutory guidelines in Jharkhand.

2. The Curated Marketplace & transparent terms Principle

HOMES by ASB operates on the strict premise of property owner-to-tenant and owner-to-buyer transactions:

• transparent coordination Commission: We do not charge landlords or tenants one month’s rent or commission percentages for connecting with each other through the platform.
• Prohibition of Third-Party Agents: Real estate brokers, middlemen, and unauthorized agency scouts are strictly prohibited from posing as genuine landlords or posting phantom duplicate properties on HOMES by ASB.
• Transparent Relationship: Negotiations, lease tenure, security deposit terms, and rent lock-in agreements remain the sole prerogative of the landlord and prospective tenant.

3. Property Owner Listing Warranties & Obligations

When you list a flat, independent house, duplex, or commercial unit on HOMES by ASB, you represent and warrant that:

• Legal Title & Authorization: You are the lawful owner, co-owner, or legally authorized attorney of the property being listed.
• Accurate Specifications: All entered specifications—including carpet area, total floors, facing direction, availability date, security deposit, maintenance fees, and furnishing state—are truthful, accurate, and physically verifiable.
• Genuine Photos: All uploaded media files represent the actual current condition of the specific unit in Ranchi, and do not constitute stock photography or images of adjacent flats.
• Prompt Contact Availability: You agree to provide a valid mobile number and respond courteously to confirmed walkthrough appointments booked through the platform.
• Prompt Status Updates: Once a property is rented or sold, the owner is required to update its status or remove the listing via the Resident Hub within 24 hours to avoid inconvenience to genuine families.

4. Physical On-Ground Verification & Audit

To ensure total trust across Ranchi real estate, HOMES by ASB conducts randomized physical inspections and field audits:

• Right to Audit: Our local field coordinators reserve the right to visit listed addresses across Ranchi (including Kanke Road, Morabadi, Lalpur, Bariatu, Doranda, etc.) to verify ownership, measure rooms, and document exterior and interior condition.
• Inspection Badge: Properties that successfully pass physical ground audits are awarded the green "ASB Ground Inspected" badge.
• Immediate Delisting of False Submissions: If a listing fails physical verification, misrepresents its carpet area by more than 10%, or contains ghost addresses, it will be terminated immediately.

5. Tenant & Homebuyer Code of Conduct

Tenants and buyers utilizing HOMES by ASB agree to:

• Punctuality for Walkthroughs: Arrive punctually for confirmed walkthrough slots and notify the landlord promptly via phone or WhatsApp if rescheduling is necessary.
• Legitimate Inquiries: Use owner contact details strictly for genuine inspection and lease discussions. Harassment, unverified commercial solicitations, or fraudulent intent are strictly forbidden.
• Physical Inspection Before Payment: Never transfer token money or advance rent without physically inspecting the premises, verifying the landlord's original identity, and executing a written rental agreement.

6. Real Estate & Legal Disclaimer

Facilitator Status: HOMES by ASB serves as an independent technology marketplace and on-ground verification facilitator. We are not a registered real estate broker, nor do we act as legal counsel or escrow agent for financial transactions between private parties.

RERA & Due Diligence: While our ground team inspects physical specifications and address authenticity, users are strongly advised to exercise due diligence, examine registry deeds, building sanctions, encumbrance certificates, and execute proper notarized agreements prior to large financial transactions. HOMES by ASB is not liable for private tenancy disputes arising post-move-in.

7. Governing Law & Jurisdiction

These Terms shall be governed by, construed, and enforced in accordance with the laws of India. Any disputes, claims, or controversies arising out of or relating to the use of HOMES by ASB shall be subject to the exclusive jurisdiction of the competent civil and consumer courts situated in Ranchi, Jharkhand.
