1. Platform Intellectual Property & Trademarks
The HOMES by ASB brand name, the ASB logo, graphic designs, icons, UI styling, software codebase, database schemas, and proprietary restriction-free algorithms are the exclusive intellectual property of HOMES by ASB and its operating entity [LEGAL_ENTITY_NAME_PLACEHOLDER].
No user or third party may reproduce, reverse-engineer, decompile, distribute, or create derivative works from our platform or brand assets without explicit prior written authorization.
2. User-Generated Content License
When property owners or tenants upload listing descriptions, photos, or reviews to the platform, you retain copyright ownership in your original works.
By uploading content, you grant HOMES by ASB a non-exclusive, royalty-free, worldwide, transferable license to display, host, resize, and promote the listing content on our website and associated mobile applications strictly for facilitating housing connections.
3. Copyright Infringement & Takedown Notices
We respect the intellectual property rights of artists, photographers, and property owners. In accordance with the Indian Copyright Act, 1957, and the Information Technology Act, 2000, we will respond promptly to valid notices of alleged copyright infringement and remove infringing content upon verification.
4. How to Submit a Takedown Notice
If you believe your copyrighted property photos or text have been copied without permission, send an infringement notice containing:
- Identification of the copyrighted work claimed to have been infringed (or URL of original source).
- Exact URL or Listing ID of the infringing material on our platform.
- Your full name, contact address, phone number, and official email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner.
- A physical or electronic signature of the copyright holder or authorized agent.
5. Counter-Notice & Restoration Process
If content you uploaded has been removed due to an infringement notice and you believe the removal was a mistake or misidentification, you may submit a formal counter-notice providing evidence of your authorization to use the material.
